Court upholds Anti-Monopoly Service-Eurocement deal

MOSCOW, August 25 (RIA Novosti) -- The Moscow District Federal Arbitration Court approved Friday an out-of-court settlement between Russia's Federal Anti-Monopoly Service and Eurocement, the country's largest cement producer.

The service and the company signed the deal following a dispute over monopolization charges July 3.

"The court upholds the amicable settlement as it is not in conflict with the law and does not violate the rights of third parties," the court ruling said.

Under the deal, Eurocement must inform the Anti-Monopoly Service of price rises of more than 5%, invest 10 billion rubles ($373 million) by 2010 in modernizing its infrastructure, and pay into the budget 267 million rubles ($9.9 million) of its revenues earned as a result of violating anti-monopoly laws.

The service accused Eurocement in October of breaching competition laws by raising prices by 70% from March 1, 2005, and ordered it to lower its prices "to a level of fair competitive pricing."

Eurocement appealed the decision, saying the Anti-Monopoly Service failed to prove that the company dominated the cement market, and did not take into account dealer markups of 35%, which were also influencing the market.

The Moscow Arbitration Court rejected the company's appeal January 10, and Eurocement filed an appeal with a higher court, which struck down the anti-monopoly regulations March 31. The Anti-Monopoly service, in turn, appealed to the Moscow District Federal Arbitration Court.

Under the agreement with the Anti-Monopoly Service, Eurocement also pledged to abide by anti-monopoly legislation and to not abuse its leading position on the market.

Service head Igor Artemyev said earlier that courts had approved amicable settlements between the Anti-Monopoly service and economic entities on several previous occasions, and insisted that his service had the right to conclude such deals.
