Arrested on tax evasion charges just days after accusing police investigators in a $230 million tax refund fraud, Magnitsky died after almost a year in the Matrosskaya Tishina pre-trial detention center in Moscow in November 2009.

Investigative Committee spokesman Vladimir Markin said on Monday the committee had made a decision to “stop the criminal prosecution of laboratory doctor Larisa Litvinova,” who was charged with negligence contributing to Magnitsky’s death.

Magnitsky was serving as outside counsel for the British investment fund Hermitage Capital Management when he uncovered the alleged tax fraud. Hermitage Capital reported earlier on Monday that Litvinova’s case was closed because the statute of limitations had expired.

Magnitsky had been diagnosed with pancreatitis and gall bladder disease. Prison officials said he died due to heart failure and toxic shock.
Following his death, Litvinova was promoted and transferred to the Federal Penitentiary Service in Moscow, Hermitage Capital said.

Another prison doctor, Dmitry Kratov, is the only official still facing charges over Magnitsky's death. He may be jailed for five years if found guilty.
