Court abandons trial of Yukos appeal against extra tax claim

MOSCOW, June 23 (RIA Novosti) - Moscow's Arbitration Court has halted proceedings on oil company Yukos's appeal against 108 billion rubles ($3.99bln) in back taxes for 2004.

The proceedings were dropped as the tax claim had been upheld as part of the bankruptcy case against Yukos [RTS: YUKO], a RIA correspondent reports from the courtroom.

The Federal Tax Service said March 17, 2006 Yukos owed $3.99 billion in back taxes for 2004, saying the company had avoided taxes by using its subsidiaries and lower transfer pricing schemes in oil deals.

Yukos appealed the decision June 1, 2006.

On June 14, a court considering Yukos' bankruptcy case ruled the 2004 tax claim should be included in the list of creditors' claims to the embattled oil company.

"Cementing the decision on the additional tax claim [for 2004] is original, but unlawful," a Yukos representative said in the Arbitration Court Friday.

He said a separate trial should look into the legitimacy of additional tax claims.

The court had earlier upheld tax bodies' claims to the embattled oil company for 2000-2003, which total 576 billion rubles ($21.29bln).

Once Russia's major independent oil producer, Yukos is facing heavy debts and tax arrears and its founder Mikhail Khodorkovsky is serving an eight-year jail term on fraud and tax evasion charges.
