Strasbourg rules Polish gays can inherit property from partners

The European Court of Human Rights has ruled that Poland's homosexuals have the right to inherit property from their partners, the Polish Radio Foreign Service said on Tuesday.

The Strasbourg court found that the authorities of the northwestern Polish city of Szczecin had violated the European Convention on Human Rights by denying Piotr Kozak the right to inherit an apartment from his deceased partner.

The authorities tried to evict Kozak from his apartment while the Szczecin court ruled that the man had no title to the apartment because in common-law marriage the right is reserved solely for heterosexual couples.

Polish law does not recognize same-sex marriages or partnerships.

The European Court of Human Rights established that the Polish authorities violated Article 14 of the Convention relating to the ban on discrimination and Article 8 concerning the right to a family life.
