The death toll in the Ukrainian accident involving a train that collided with a passenger bus has reached 42, including two children, the Ukrainian Emergency Ministry said on Tuesday.

Earlier it was reported 40 people were killed with 10 others in critical condition. Police have set the number of dead at 38.

The accident occurred on Tuesday morning in the town of Marganets when a train en route to Krivoy Rog and Zaporozhye slammed into a passenger bus at a railway crossing. The bus driver drove onto the railroad, despite a warning from a railroad traffic control signal.

Russian President Dmitry Medvedev sent his condolences to Ukrainian President Viktor Yanukovich on Tuesday.

"It is hard to express the feelings of compassion...If necessary we are ready to render any help to the injured," Medvedev said in his statement.

The president also expressed his condolence to the relatives of those killed in the deadly crash.

Yanukovych is set to announce October 13 as a national day of mourning.

A criminal case was started into the tragedy over the violation of the traffic rules.

Ukrainian Prime Minister Mykola Azarov said the government would pay $12,500 in compensation to the families of the victims.
